MEMBERSHIP AGREEMENT

This Membership Agreement ("Agreement") is entered into by and between Elite Personal Training Centre, hereinafter referred to as "Elite PT", and [Member's Name], hereinafter referred to as "the Member", effective as of [Effective Date], on a rolling monthly basis.

1. Services:

The membership entitles the Member to utilise Elite PT facilities, equipment, and services available therein, subject to the terms and conditions outlined in this Agreement. Access is granted to all Elite PT sites, unless otherwise specified.

2. Membership:

The membership is personal and non-transferable, and may not be shared with others.

3. Age Limit:

The Member confirms they are 18 years of age or older. Exceptions may be granted for individuals aged 16 or 17 with written parental consent. Persons under 16 must be supervised at all times.

4. Health Declaration:

The Member confirms they do not suffer from any health problems that would hinder exercise or pose a risk to their health. Any changes in health status affecting their ability to exercise safely during the membership term must be promptly communicated to Elite PT.

5. Liability and Waiver of Liability:

The Member acknowledges liability for any property damage or personal injury caused by their actions on Elite PT premises. Elite PT shall not be liable for injuries, damages, or claims arising from the use of facilities or equipment.

6. Lost Property or Theft:

Elite PT is not responsible for the loss or theft of personal belongings. Items left on premises will be kept for two weeks before disposal.

7. Code of Conduct:

The Member agrees to adhere to Elite PT's code of conduct, as outlined by management. Breaches may result in membership suspension or termination at management's discretion.

8. Payment:

The Member acknowledges and agrees to make monthly payments of £197.00, commencing on the date this contract is signed. Subsequent monthly payments of £197.00 are due on the same date each month thereafter until cancellation is requested by the Member. The Member authorizes Elite PT to automatically debit this amount from their designated account or card on the specified payment date each month. In the event of any changes to the payment schedule or method, the Member agrees to promptly inform Elite PT in writing.

8a. Payment Terms:

The Member is solely responsible for ensuring timely payment of the membership fees. This obligation remains binding even if the amount is debited directly by Elite PT. For monthly memberships, the payment amount is due at the inception of this agreement. In the event of late payment, the Member will receive a reminder email from Elite PT, and access to facilities will be suspended. Membership continues during periods of access suspension, and any outstanding payments remaining unpaid after 30 days will result in the Member being in violation of the contract. Elite PT reserves the right to transfer such cases to debt collectors, incurring additional fees. The Member's approval for automatic debit from their account or card is deemed provided, and cancellation must be notified at least 60 days before the next debit.

8b. SATISFACTION GUARANTEE:

Within 7 days of membership commencement, the Member may cancel their membership free of charge and receive a full reimbursement.

9. Cancellation Policy:

Cancellation requests must be submitted in writing to simon@elitept-rhyl.co.uk at least 60 days prior to the next billing cycle. Failure to provide timely notice will result in automatic renewal of the membership, and any outstanding payments not made within this 60 days notice period will be pursued through third-party collection agents for immediate recovery. Please note that failure to resolve outstanding payments will result in adverse effects on the member's credit score.

10. Renewal:

Membership contracts automatically renew on a rolling monthly basis unless cancelled as per the cancellation policy. Elite PT will send a reminder email one month before the end of the contract period.

11. Price Changes:

Elite PT reserves the right to adjust membership fees in accordance with changes in the Consumer Price Index (CPI) rate of inflation. Any potential future price increases will be communicated to Members at least one month prior to implementation.

12. Frozen Membership:

Members have the option to freeze their membership for up to two months. However, the duration of the freeze period will be added to the end of the membership contract term.

13. Miscellaneous:

a. This Agreement constitutes the entire understanding between the parties, superseding any prior agreements.

b. By signing this Agreement, the Member acknowledges understanding and acceptance of its terms.

c. If any provision of this Agreement is deemed invalid, the remaining provisions shall remain in effect.
